So moved. Variance is conditioned on plans <br />from Bennett Engineering, dated November 30, 2007, revised <br />January 9, 2008. <br />JW Builders, Inc.: Requests a Variance (previous V-06-28 has <br />expired) from Sections 174-31, 174-33 and 174-59 of the Zoning By- <br />laws to seek relief from lot size requirements, frontage requirements, <br />distance to the wetlands and elevation by-laws in order to build a <br />new house on property located in an R-3 zoning district at 387 <br />Monomoscoy Road (Map 125 Parcel 3) Mashpee, MA. <br />Attorney.Kevin Kirrane asks that the matter be continued for a full <br />quorum. Mr. Nelson says this is. fine and the matter is continued until <br />January 23, 2008. <br />Janez Hicks: Requests a Special Permit from Section 174-20 of the <br />• Zoning By-laws to demolish the existing dwelling and replace it with a <br />new three bedroom house on property located in an R-3 zoning <br />district at 57 Orchard Road (Map 62 Parcel 1) Mashpee, MA. <br />Sitting: Robert Nelson, James Reiffarth, George Bolton and William <br />Blaisdell. <br />Janez Hicks represents herself at this hearing. She is seeking a <br />Special Permit to tear down the existing dwelling. The whole <br />foundation is coming out and they are able to meet all existing <br />setback requirements. The dwelling is a pre-existing non -conforming <br />structure and the new house is more conforming.' The Board reviews <br />the plans and find this to be an improvement in the area.. Robert <br />Nelson moves to grant a special permit. James Reiffarth seconds the <br />motion. All agree. So moved.. Reference plans from Cape & Islands <br />Engineering, dated November 28; .2007, File No. 158MA. <br />David Melish: Requests a Special Permit from Section 174-17 of <br />the Zoning By-laws in order to alter a pre-existing non -conforming <br />dwelling on property located in an R-3 zoning district at 63 Riverside <br />. Drive (Map 120 Parcel 1) Mashpee, MA. <br />
