TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, January 23, 2008 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on <br />Wednesday, January 23, 2008. at the Mashpee Town Hall. Board <br />Members Robert Nelson, James Reiffarth Zella Elizenberry and <br />Jonathan Furbush were present. Alternate member William Blaisdell <br />was also present. Member George Bolton was absent. <br />Robert Nelson opens the hearing at 7:00 p.m. <br />•John Petrick: Requests a Special Permit from Section 174-25(I)(9) <br />of the Zoning By-laws in order to construct and maintain in <br />perpetuity a pier, ramp and float in Popponesset Bay on property <br />located in an R-3 zoning district at 106 Captains Row (Map 96 Parcel <br />15) Mashpee, MA. <br />John Slavinsky represents the applicant at this continued <br />hearing. They have been delayed in Conservation for many weeks <br />due to the fact that the Harbor Master wanted the pier moved farther <br />away from the moorings. This had to be done with the Corps of <br />Engineering involved and it took a long time. Mr. Slavinsky presents <br />new plans to the Board and they review them. Mr. Furbush mentions <br />the length of the dock — Mr. Slavinsky tells him it is 70 feet and does <br />not need a variance. The Conservation Commission issued the order <br />of conditions on January 15, 2008. The Board has no problem with <br />the special permit. Jonathan Furbush makes a motion to grant a <br />Special Permit. Zella Elizenberry seconds the motion. All agree. So <br />moved. Reference plans from Cape & Islands Engineering, dated <br />October 18, 2007, and revised December 20, 2007. <br />
