Mashpee Zoning <br />Board of Appeals Agenda <br />• 2 February 13, 2008 <br />Mashpee Commons Limited Partnership: Requests a Variance from Section 174-31 of the <br />Zoning By-laws, for 5 feet to vary the side -line setback with certain conditions, to operate and <br />build a retail/office/restaurant and residential mixed-use complex and to address actual built <br />conditions, relocate certain square footage of building space and location of parking areas and <br />previously approved residential units. Such minor changes are permitted under the C-1 zone of <br />the Town of Mashpee Zoning Ordinance, do not increase the gross square footage authorized <br />under the existing Special Permit, and as a result, will not increase the intensity of use of the site <br />and will result in a more aesthetically pleasing plan. As per condition no. 5 of SP -86-04-024, <br />applicant is requesting such changes be approved by the Mashpee Zoning Board.
