Mashpee Zoning <br />Board of Appeals Minutes <br />• 3 February 13, 2008 <br />permitted under the C-1 zone of the Town of Mashpee Zoning <br />Ordinance, do not increase the gross square footage authorized <br />under the existing Special Permit, and as a result, will not increase <br />the intensity of use of the site and will result in a more aesthetically <br />pleasing plan. As per condition no. 5 of SP -86-04-024, applicant is <br />requesting such changes be approved by the Mashpee Zoning Board. <br />This request is made on property located in a C-1 zoning district at <br />38 Nathan Ellis Highway (Map 74 Block 20) Mashpee, MA. <br />Mashoee Commons Limited Partnership: Requests a Variance <br />from Section 174-31 of the Zoning By-laws, for 5 feet to vary the <br />side -line setback with certain conditions, to operate and build a <br />retail/office/restaurant and residential mixed-use complex and to <br />address actual built conditions, relocate certain square footage of <br />building space and location of parking areas and previously approved <br />residential units. Such minor changes are permitted under the C-1 <br />zone of the Town of Mashpee Zoning Ordinance, do not increase the <br />gross square footage authorized under the existing Special Permit, <br />and as a result, will not increase the intensity of use of the site and <br />will result in a more aesthetically pleasing plan. As per condition no. <br />5 of SP -86-04-024, applicant is requesting such changes be approved <br />by the Mashpee Zoning Board. This request is made on property <br />located in a C-1 zoning district at 38 Nathan Ellis Highway (Map 74 <br />Block 20) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James <br />Reiffarth and William Blaisdell. <br />SPECIAL PERMIT <br />Mr. Douglas Storrs, Vice President of Mashpee Commons <br />Limited Partnership, represented the applicant's request for a <br />Modification to an Existing Special Permit. Condition #5 of the Special <br />Permit, SP -86-04-024, as previously modified, requires the applicant <br />to request and receive consent from the Zoning Board of Appeals for <br />• any revisions to the original Special Permit.
