c: <br />Mashpee Zoning <br />Board of Appeals Minutes <br />5 February 13, 2008 <br />Mashoee Commons Limited Partnership: Requests a Variance <br />from Section 174-45.5 of the Zoning By-laws for land based wind <br />conversion facilities to be installed on existing building 11B (Talbot's <br />Store) on property located in a C-1 zoning district at 38 Nathan Ellis <br />Highway (Map 74 Parcel 20) Mashpee, MA. <br />Robert Nelson informs Mr. Storrs that they have asked Town Counsel <br />for his opinion on this matter since the Planning Board is telling us it <br />is illegal to issue with the way the by-law is set up. They have <br />introduced a new by-law that will go before May Town Meeting to <br />clear up the matter of installing wind turbines in Mashpee. Mr. <br />Nelson would prefer .not to get into this matter until he sees what <br />town counsel has to say. Mr. Storrs just wants to outline it briefly. <br />The wind turbines in question were just recently brought into <br />America. They may not be roof mounted but can be pole mounted <br />due to the noise and vibrations. The wind turbine spins the electric <br />meeting backwards for the profit margin but needs to be set up in a <br />common area in order to gain payback issues. The Planning Board <br />will allow roof mounted wind turbines when the law is amended. It is <br />a dimentional request and is unresolved at the moment. They are <br />waiting for Town Counsels comments. If an accident happened, <br />where would we be? The question remains is if it is a use variance it <br />was put in the wrong section. It is a change in the use of the <br />building? Solar? Is it a use change? Its generating power in a <br />different fashion. This remains to be decided. This shall be <br />continued until March 12, 2008. <br />Seeing no further business, Bob Nelson makes a motion to adjourn <br />the meeting. Jonathan Furbush seconds the motion.
