(USi7y a <br /> Mashpce <br /> 16 Grca,t Neck. load,Yor-th <br /> MASHPEE ZONING BOARD OF APPEAisjjee, lhlassachusetts 62649 <br /> DECISION FOR A VARIANCE <br /> RE: Karen Scott 750 Cotuit Road <br /> Map 7 Parcel 8 <br /> V-08-08 <br /> A Petition was filed on February 4, 2008 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the sideline setbacks in order build a garage <br /> and farmers porch/entryway on property located in an R-5 zoning district at 750 Cotuit <br /> Road (Map 7 Parcel 8) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on February 15, 2008 and <br /> February 22, 2008 , a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 27, 2008 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, James Reiffarth, <br /> Jonathan Furbush, and William Blaisdell. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Nelson informs applicant that he may continue this matter if he wishes due to <br /> the fact that there are not 5 members present to vote. Eric Oman, builder for applicant, <br /> wishes to proceed. He is seeking a variance in order to build a garage and farmer's porch <br /> onto existing house. The Board views the plans and the size of the lot to see if there is <br /> any other alternative to this proposal. There is some further discussion neighbors and the <br /> variance request. After some review Jonathan Fubush moves to grant an 11.7 foot <br /> northerly side variance and a 14.8 foot southerly side variance. James Reiffath seconds <br /> the motion. All agree. So moved. <br />
