Jonathan Furbush makes a motion to grant the <br /> Special Permit with the following conditions:, <br /> ■ Approval from Conservation Commission on the Talbot Plan dated 2/1/08. <br /> ■ Michael Talbot's landscaping plan stamped with Cape & Islands dated January <br /> 12, 2008 revised January 25, 2008, revised February 1, 2008 <br /> ■ Plans from Jolui Dvorsack of Falmouth, MA, dated 11/16/07. <br /> James Reiffarth seconds the motion. All agree. So moved. Plans referenced above are <br /> conditioned on this permit. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General Laws <br /> Chapter 40A, Chapter 6; require a finding that the extension, alteration or change shall <br /> not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 155 Popponesset Island Road and <br /> contains 18,000 square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. there is adequate land area to provide sufficient parking. <br /> 2. the immediate neighborhood consists of single-family homes of similar size; <br /> many of which have been improved with additions or reconstruction. <br /> 3. there will be the installation of a new septic system. <br /> 4. the proposed dwelling will be less non-conforming that what currently exists <br /> now. <br /> 5. the number of bedrooms will be reduced from four to three, thus reducing the <br /> total effluent to this neighborhood. <br /> hl view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. 'Upon <br /> motion duly made and seconded,the Zoning Board of Appeals voted unanimously on <br />
