lown of Nashpee V}II 16 Grca.t deck 1�oacl JVor-th, >c> , �1�'lasl2�c , 1�'lassaclrccsctts D.`,6=1<) MASHPEE ZONING BOARD OF APPEALS Decision for a Variance RE: Daniel Wyzik 116 Quinaquisset Ave Map 69 Parcel 97 V-08-20 A Petition was filed on April 18, 2008 for a Variance from Section 174-31 of the Zoning By-laws to vary the current setback requirements on property located in an R-3 zoning district at 116 Quinaquisset Ave (Map 69 Block 97) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation on April 25, 2008 and May 2, 2008, a copy of which is attached hereto and made a part in the Town of Mashpee, on hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, May 14, 2008 at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James Reiffarth, William Blaisdell and Peter Hinden. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of Mashpee Zoning By-laws. Donald Wyzik represents he and his wife at this hearing. They are seeking a variance on the side yard in order to build a 22 ` x 40' garage . They are installing a new septic system and they submit a letter in support of this project from their neighbors the Kaestners at 112 Quinaquisset Ave. The Board reviews the plans and feel the garage will be an improvement to neighborhood. The variance requested is 4.7 feet and the proposed lot coverage will be 13.1%. James Reiffarth makes a motion to grant the 4.7 variance on the southwesterly side. Jonathan Furbush seconds the motion. All agree. So moved.
