ee,tiaccnr�. <br /> < rt <br /> ! y Town of Mashpcc <br /> 16 Ga-eat rVck I�oad Ne)rth <br /> Alash,pcc, A'Ja,ssachusetts 09649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Variance - DENIED <br /> RE: Martin and Margo Finch 39 East Road <br /> Map 2 Block 78 <br /> V-08-21 <br /> A Petition was filed on April 11, 2008 for a Variance from Section 174-31 of the <br /> Zoning By-laws for variance relief in order to build a 8 x 24 foot deck on property <br /> located in an R-5 zoning district at 39 East Road (Map 2 Block 78) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on April 25, 2008 and May <br /> 2, 2008 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 14, 2008, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, James Reiffarth, Jonathan <br /> Furbush, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Martin Finch represented himself on this application for a variance in order to <br /> build a deck. They are seeking side and front variance relief in order to build a front <br /> deck. George Lambros, Builder for applicant is also present. Mr. Nelson right away asks <br /> what the hardship is for this request. Mr. Finch tells the Board that the grading on the <br /> property is so bad they cannot walk outside without a deck. The Board mentions that <br /> they already have one deck and if they cannot possibly extend the side deck instead of <br /> building a new one. Mr. Finch states that the double deck is more stable and looks better. <br /> The Board and the applicant debate on some suggestions and alternatives instead of <br /> building another deck. Robert Nelson mentions the average setback rule and says it <br /> would not apply because applicant would be going out to far. Mr. Furbush suggests <br />
