Unfortunately there is no
Mashpee Zoning Ordinance relative to the length of stay at a hotel/motel, The only reference is
in the definition section which states," A structure containing fifteen (15 ) or more sleeping
rooms, with or without a common eating facility, each room having it's own private toilet
facilities and each room let for compensation. ".
The State Building Code, 780 C'MR Sixth Edition, classifies this as an R-t use group which
shall include-all hotels, motels and boarding houses and similar buildings arranged for shelter
and sleeping: accommodations and in which the occupants are " PRIMARILY " transient in
nature, occupying the facilities for a period of less than a0 days, f believe Massachusetts
General Law mimics this language. The key word here is " PRIMARILY
I believe that the La Plaza Del Sol is in compliance relative to unit #4.
1 do plan to pose this question to Town Counsel for his opinion and if his interpretation differs
from mine I will contact you..
Thank you for your concerns.
Sincerely,
Richard Step .O s
Building Commissioner
