Mashpee Zoning Town of Mashpee 5 <br /> Board of Appeals Proposed Library <br /> 5 V-08-23 <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> l. that relief may be granted without detriment to the public good. <br /> 2. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 3. that the dwelling is burdened with three frontages. <br /> 4. a municipal building is being built next door and will align aesthetically with <br /> this project. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of the requested Variances. Upon <br /> motion duly made and seconded, the Zoning Board of Appeals voted unanimously on <br /> May 14, 2008 to grant the following: <br /> 1. the elimination of the 10 foot sideline vegetative buffer commencing at <br /> Steeple Street and running and continuing 180 feet along the easterly property <br /> line of the parcel for the purposes of the creation of a sidewalk and or parking <br /> 2. 28.9 feet from Steeple Street; <br /> 3. 10.4 feet from Jobs Fishing Road; <br /> 4. 15 foot intrusion into the 50 foot vegetated buffer set back along the entire <br /> frontage from Route 151 for paved parking purposes <br /> 5. 11.5 feet to the height of the building, to be approximately 46.25 feet. <br />
