Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 9, 2008 and May 16, <br /> 2008 , a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 28, 2008, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, Peter <br /> Hinden and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Betsy Mello represents herself and is seeking a Special Permit in order to conduct <br /> Zumba Dance Classes. She leases this space from the owner and was not aware she <br /> needed a different kind of permit. She has classes once a day for an hour Monday— <br /> Saturday and a one hour session on Monday and Tuesday evening. She informs the <br /> Board there are about 5 — 10 people present during these classes. She went to the <br /> Design/Plan Review and they had several concerns that should be the responsibility of <br /> the owner. The Building Commissioner indicates that there were no building/plumbing <br /> r <br /> permits pulled for the bathroom that exists there and no certificate of occupancy was <br /> issued for that building. The space was originally designed for contractor bays and <br /> storage not for public use. She would need 11 parking spaces which is available to her <br />
