Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 9, 2008 and May 16, <br /> 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 28, 2008 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, Peter <br /> Hinden and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Stuart Bornstein represents his son at this hearing. They are seeking to raze and <br /> replace the existing dwelling. The Board reviews both the special permit and variance <br /> application. Mr. Nelson recommends the variance requests be withdrawn since the new <br /> dwelling will be using the same foot print and will actually have less lot coverage that the <br /> existing house. This can be done with a special permit since it is a pre-existing non- <br /> conforming dwelling. The Board agrees to have the variance request withdrawn. The <br /> site plan says that the existing dwelling is 4 bedrooms. However, the assessing <br /> department has had the home listed as a 2 bedroom dwelling for many years.
