The variance <br /> request is questioned by several of the abutters—Mr. Bornstein is not asking for any <br /> further side yard setbacks, or making the house any larger. He has removed the deck in <br /> order to reduce the existing lot coverage from 25.8% down to 24.6%. He is aware of the <br /> 20 % that the ZBA does not like to go beyond. <br /> Mr. Nelson and Mr. Furbush inform the abutters that each of these lots is very <br /> small much like their own. They have taken these requests case by case to ensure they <br /> are able to accommodate applicants request to the best of their ability as well as what is <br /> best for the town. The Board and the abutters further discuss the number of bedrooms <br /> and the size of the dwelling. Should the Board grant the Special Pern-lit, they will impose <br /> certain restrictions to accommodate the abutters concerns. <br /> The abutters ask what the height of the dwelling will be since it is not mentioned <br /> on the site plan. The Building Inspector informs the ZBA as well as the applicants that <br /> the height restriction is 35 feet for a residential dwelling. Mr. Bornstein will stay within <br /> that restriction. <br /> Mr. Furbush discusses the removal of the deck. The Board will restrict that no <br /> decks may be added that will increase the lot coverage. Patios are acceptable and do not <br /> add to lot coverage. <br /> Jonathan Furbush makes a motion to grant the Special Permit with the following <br /> restrictions. <br /> ■ No decks will be allowed that will add to the lot coverage of the new <br /> dwelling. <br /> ■ This permit is subject to all approvals from the Board of Health at which <br /> time they will determine the number of bedrooms to be allowed. <br /> ■ The height of the new dwelling will not go beyond the 35 feet that is <br /> allowed. <br /> Robert Nelson seconds the motion. It is a unanimous vote. So moved. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 4 Pine Avenue and contains 5,000 square <br /> feet. <br />
