'd <br />Mashpee Zoning <br />Board of Appeals Minutes <br />• I May 28, 2008 <br />Zoning Board of Appeals <br />Minutes — Wednesday, May 28, 2008 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on <br />Wednesday, May 28, 2008. at the Mashpee Town Hall. Board <br />Members Robert Nelson, Jonathan Furbush, were present. Alternate <br />Board members Jack Dorsey and Peter Hinden were present. Board <br />Member Zella Elizenberry, James Reiffarth and William Blaisdell were <br />absent. <br />Jonathan Furbush read the continuances. <br />Robert Nelson explains to the applicants that they have the right to a <br />full complement of Board members which they do not have this <br />evening. He informs them that all votes tonight must be in a positive <br />• form in order for the motion to pass. They have the right to ask for a <br />continuance. All applicants choose to stay and have their hearings <br />heard. <br />Ethan and Sandra Bornstein: Request a Special Permit from Sections 174-17 and 174- <br />20 of the Zoning By-laws in order to raze and replace the pre-existing non -conforming <br />dwelling and re -build within the same foot print with a single family, 4 bedroom house <br />on property located in an R-3 zoning district at 4 Pine Avenue (Map 123 Parcel 35) <br />Mashpee, MA. Owner of Record: T. Mark and Pauline Bartlev <br />Ethan and Sandra Bornstein: Request a Variance from Section 174-31 of the Zoning <br />By-laws for landspace relief and for setback relief in order to raze and replace a pre- <br />existing non -conforming dwelling and re -build within the same foot print with a single <br />family, 4 bedroom house on property located in an R-3 zoning district at 4 Pine Avenue <br />(Map 123 Parcel 35) Mashpee, MA. Owner of Record: T. Mark and Pauline Bartlev <br />Stuart Bornstein represents his son at this hearing. They are seeking to raze and replace <br />the existing dwelling, The Board reviews both the special permit and variance <br />application. Mr. Nelson recommends the variance requests be withdrawn since the new <br />dwelling will be using the same foot print and will actually have less lot coverage that the <br />existing house. This can be done with a special permit since it is a pre-existing non- <br />conforming dwelling. The Board agrees to have the variance request withdrawn. There <br />• were two site plans submitted, one showing the existing dwelling and the other site plan <br />showing the proposed dwelling indicates a 4 bedroom house to be built. However, the <br />
