Mashpee Zoning
Board of Appeals George Bezreh
2 V-08-27
James Reiffarth makes a motion to grant a 5 foot variance in the rearyard. Jonathan
Furbush seconds the motion. All agree. So moved.
GENERAL FINDINGS
1. that the subject property is located at 97 Surf Drive and contains 12,177
square feet.
SPECIFIC FINDINGS
The Board determined that:
1. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
3. The Board wants the pool properly surveyed by and Registered Land
Surveyor for accuracy.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly
made and seconded, the Zoning Board of Appeals voted unanimously on June 11, 2008 to
grant a 5 foot rear setback in order to build an above-ground pool. Variance is
conditioned on plans from Cape & Islands Engineering, dated May 27, 2008.
