Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on June 6, 2008 and June 13,
2008 a copy of which is attached hereto and made a part hereof.
A Public Hearing was scheduled to be held on June 25, 2008, but the hearing for
the Petition was held on Wednesday, July 9, 2008 at the Mashpee Town Hall at which
time the following members of the Zoning Board of Appeals were present and acting
throughout: Robert Nelson, James Reiffarth, Jonathan Furbush, William Blaisdell and
Jack Dorsey.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of
Mashpee Zoning By-laws.
Robert Nelson reads portions of a letter of opposition into the record from Mr.
and Mrs. Schulz of 112 Old Brickyard Road. They are against the dock. They mention
excessive traffic of watercraft coming and going. Mr. Nelson says much of this letter is
moot since the dock application has changed and there is no walkway being proposed
only a dock.
