Board Members Robert Nelson, Jonathan Furbush, James Reiffarth and <br />William Blaisdell were present. Alternate Board members Jack Dorsey was present. Board <br />Member Zella Elizenberry, and alternate member Peter Hinden were absent. <br />Chairman Robert Nelson opens the hearing at 7:00 p.m. <br />Jonathan Furbush reads the continuances. <br />Alex MacLellan: Seamist Builders - 403 Great Oak Road — Extension on existing variance. Mr. <br />MacLellan would like to address the Board regarding his variance. <br />Mr. MacLellan owns a lot on 403 Great Oak Road and was issued a variance that is due to expire the <br />end of July. He is first, asking the Board for a 6 month extension. He addresses the Board about how <br />difficult the economy has been for him and that he doesn't know what he will do if he cannot sell the lot. <br />He was told originally that it was part of Little Neck Bay and there was only a 15,000 square foot <br />requirement to be a buildable lot. It is in an R-3 zoning district and the variance shows that it required <br />40,000 square feet to be buildable and he also needed relief from the ACEC due to the house he presented <br />on the lot to be built. The Board makes some suggestions as to what he would need to do to show the lot is <br />part of Little Neck Bay and then perhaps would not need a variance. Mr. Nelson discusses the water pipe <br />that the Town put in that lies within his property. Mr. Furbush suggests going to the Registry of Deeds to <br />prove he is part of the Little Neck Bay area. They will need written proof and some sort of subdivision <br />plan to begin with. The ARC in New Seabury may be able to help his as well. Mr. MacLellan mentions <br />that he would have had the land sold to the person who bought his other lot next door however, he wanted <br />it for his children many years from now and the variance will expire after one year. Mr. MacLellan again <br />says how desperate he is and his whole life is tied up in this lot. The Board acknowledges that the <br />economy is very bad but he must begin the process to prove the lot is within the Little Neck Bay <br />subdivision for them to possibly look at and they may need Town Counsel to review this as well. Mr. <br />MacLellan will get what he can and come back to the Board. He thanks them for their time. <br />There is a member in the audience names Hans Keijser, who is a student and would like to ask the Board <br />some questions. Mr. Nelson asks him to address the Board with his questions. He asks each of the <br />member why they chose to be on the ZBA, how long they have been on the board and what their likes and <br />dislikes are about it. He polls the Board and there is a short answer from each member. <br />The Board reviews the plans for the matter at 15 Tuspaquin Road where the applicant is requesting a pier, <br />ramp and float. This matter was previously filed in 2007 and withdrawn. There are also two abutters that <br />are against the dock being granted. The matter has not been heard yet by the ZBA since it is still in <br />Conservation.
