Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 27, 2008 and July 4, <br /> 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 13, 2008 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, James <br /> Reiffarth, Jack Dorsey and William Blaisdell. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape &Islands Engineering represents the applicants at this <br /> hearing. This matter was continued from July 9, 2008 due to conservation issues. They <br /> are seeking to raze and replace the dwelling and they also need a variance to the wetlands <br /> setback requirements. The existing house sits at 19 feet from the wetlands, the new <br /> house will be at 25 feet which is more conforming. The basement floor elevation will <br /> remain at 66 feet. They cannot fill in the basement due to the landbank and the <br />
