Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 27, 2008 and July 4, <br /> 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on Wednesday, July 9, 2008 and continued to August <br /> 13, 2008 on the Petition at the Mashpee Town Hall at which time the following members <br /> of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, <br /> Jonathan Furbush, James Reiffarth, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Jolui Slavinsky of Cape & Islands Engineering represents the applicants at this <br /> hearing. This matter was continued from July 9, 2008 due to conservation issues. They <br /> are seeping to raze and replace the dwelling and they also need a variance to the wetlands <br /> setback requirements. The existing house sits at 19 feet from the wetlands,the new <br /> house will be at 25 feet which is more conforming. The basement floor elevation will <br />
