Mashpee Zoning <br />Board of Appeals Minutes <br />5 July 9, 2008 <br />all suggestions. The Board of Health has authorized three bedrooms for the <br />house. Applicant is told it must remain owner occupied and she must report <br />annually that she resides there. Jonathan Furbush makes a motion to grant the <br />Special Permit. James Reiffarth seconds the motion. All agree. So moved. <br />Scott Wheeler: Requests a Variance from Section 174-31 of the Zoning By- <br />laws to seek relief from the setback requirements in order to expand existing <br />living space on property located in an R-5 zoning district at 51 Santuit Pond Road <br />(Map 17 Parcel 27) Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, William Blaisdell and <br />Jack Dorsey. <br />Scott Wheeler represents himself at this hearing. He is seeking a variance in <br />order to expand existing living space. The Board of Health has condemned the <br />house due to no heating system. Applicant is attempting to improve the home in <br />order to be able to rent the space again. Abutter Paul Nolan has submitted a <br />letter which Robert Nelson reads into the record, strongly opposing the variance. <br />He states that the house is a complete mess, the tenants have been loud and <br />have not kept up the property and this expansion will make the house closer to <br />his property. Mr. Wheeler has indicated to the Board that he has landscaped the <br />property and is aware of the list of complaints from the Board of Health. The <br />ZBA suggest he make amends with his neighbor and will require all Board of <br />Health complaints to be taken care of. Jonathan Furbush feels the <br />improvements will better the house and improve the neighborhood. Chairman <br />Nelson asks the Building Inspector if he has any problems with this variance <br />request? Rich Stevens has no problems with this request. Jonathan Furbush <br />makes a motion to grant an 8 foot variance on the southwesterly side and a 13.5 <br />foot variance on the northeasterly side. James Reiffarth seconds the motion. All <br />agree. So moved. Reference plans from John Doyle, Land Surveyor of Falmouth, <br />MA., dated June 12, 2008. <br />Obrinskv Trust: Requests a Variance from Section 174-31 of the Zoning By- <br />laws in order to allow single family residences to be built on separated parcels <br />and deem lots buildable. Relief was previously granted, however the Variance <br />has lapsed and applicant is re -applying. This relief is requested on property <br />located in an R-5 zoning district at 223 Wheeler Road (Map 49 Parcel 35) <br />Mashpee, MA. Owners of Record: Robert William Obrinskw Luisa Anne <br />Simone; Rebecca Alexandra Obrinskv: and Jessica Louis Obrinskv. <br />Diana L. Obrinskv Trustee of the Whorton-Ohrinskv Trust Requests a <br />.
