Mashpee Zoning <br /> Board of Appeals Frank Silva(Foley Auto Repair) <br /> 5 SP-08-37 <br /> capacities, will properly dispose of stumps, construction debris, hazardous <br /> materials and other waste, will provide adequate off-street parking, will not <br /> cause excessive erosion or cause increased runoff onto neighboring <br /> properties or into any natural river, stream, pond or water body and will not <br /> otherwise be detrimental to the town or the area. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 129 Industrial Drive and <br /> contains 75,984 square feet. <br /> SPECIFIC FINDINGS <br /> 1. the proposed use and development are consistent with applicable law, <br /> rules and regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> 3. there will not be an excessive demand upon community facilities <br /> created as a result of the proposal. <br /> 4. there will not be a significant adverse impact on the environmental <br /> factors listed in Section 174-24.C.2. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found <br /> that the Petitioner met the criteria necessary for the granting of a Special <br /> Permit. Upon motion duly made and seconded, the Zoning Board of Appeals <br /> voted unanimously on November 12, 2008 to grant a Special Permit <br /> conditioned on the plans from J.E. Landers-Cauley,PE., West Falmouth, MA, <br /> dated September 4, 2008, Joh No. 1349COND (called "Leaching Field <br /> Addition Plan"); plans from J.E. Landers-Cauley, of West Falmouth, MA, <br /> dated January 23, 2004, revised February 16, 2005, and revised April 5, 2004 <br /> (called "Site Plan") showing parking and landscaping; letter from James <br /> McHugh, Fire Protection Specialist dated September 30, 2008. <br />
