Mr. Cauley informs him that Conservation has <br /> asked for dry wells to be installed. He is open to the possibility of installing rain gardens <br /> if the Board deems them necessary. Mr. Nelson would like to see the lot re-graded which <br /> would include gravel being brought in to fix the pot holes in front of the lot. <br /> Additionally,there will be no basement allowed in this dwelling. After some further <br /> discussion regarding the plot plan, Mr. Nelson asks the Board if they are ready for a <br /> motion. James Reiffarth makes a motion to grant the special permit. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 38 Seconsett Point and contains 22,179 <br /> square feet. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> SPECIFIC FINDINGS <br /> 1 that there is adequate land area to provide sufficient parking. <br /> 2. the proposed construction will not increase the non-conforming nature of the <br /> structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and its <br /> use. <br /> 3. that the immediate neighborhood consists of single-family homes of similar <br /> size. Many have been improved with additions or reconstruction. <br /> 4. that installation of a new denitrification system would be an improvement on <br /> the property, should one need to be installed per the Board of Health's septic <br /> inspection. <br /> 5. The road in front of the property and the potholes will be regarded. <br />
