Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 12, 2008 and <br /> September 19, 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 24, 2008 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, <br /> James Reiffarth, Jack Dorsey and Peter Hinden. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Jack Landers-Cauley represents the application for the Ferris Special Permit and <br /> Variance request. The applicant is seeking a raze and replace. Mr. Cauley discusses the <br /> requirements of distance to the road which is 50 feet plus 20 feet. The applicants are able <br /> to meet that plus the setback requirements as well. They discussed the necessity of a new <br /> septic system which may be needed upon an inspection, which the Board of Health is <br />
