Mashpee Zoning <br />Board of Appeals Minutes <br />• 2 September 24, 2008 <br />Cornelius and Maureen Ferris: Request a Special Permit from <br />Sections 174-17 and 174-20 of the Zoning By-laws in order to raze <br />and replace the existing dwelling on property located in an R-3 <br />zoning district at 38 Seconsett Point Road (Map 124 Parcel 39A) <br />Mashpee, MA. <br />Sitting: Robert Nelson, Jonathan Furbush, James Reiffarth, Jack <br />Dorsey and Peter Hinden. <br />Jack Landers-Cauley represents the application for the Ferris Special <br />Permit and Variance request. The applicant is seeking to raze and <br />replace the dwelling. Mr. Cauley discusses the requirements of <br />distance to the road which is 50 feet plus 20 feet. The applicants are <br />able to meet that plus the setback requirements as well. They <br />discussed the necessity of a new septic system which may be needed <br />upon an inspection, which the Board of Health is requiring. Once the <br />house is demolished, then the lot becomes too small and requires a <br />• variance for landspace as well as frontage, which the applicant has <br />applied for. The proposed lot coverage is 13.7% which is well under <br />the 20% maximum. James Reiffarth asks about rain gardens being <br />installed. Mr. Cauley informs him that Conservation has asked for dry <br />wells to be installed. He is open to the possibility of installing rain <br />gardens if the Board deems them necessary. Mr. Nelson would like <br />to see the lot re -graded which would include gravel being brought in <br />to fix the pot holes in front of the lot. Additionally, there will be no <br />basement allowed in this dwelling. After some further discussion <br />regarding the plot plan, Mr. Nelson asks the Board if they are ready <br />for a motion. James Reiffarth makes a motion to grant the special <br />permit. Peter Hinden seconds the motion. All Agree. So moved. <br />James Reiffarth makes a motion to grant a 17,821 square foot <br />variance and a 75 foot frontage variance with the conditions that the <br />Board of Health requirements be met as well as that of the <br />Conservation Commission. Additionally, there is to be re -grading on <br />Seconsett Point Road up to the lot where there are pot holes and the <br />grading needs to be fixed. Jonathan Furbush seconds the motion. <br />The permits are also conditioned on plans from J.E. Landers-Cauley, <br />• P.E. of West Falmouth, Ma, Job No. 1764 and dated September 2, <br />2008. <br />
