�i <br /> shpee <br /> Town of Nia <br /> 16 Great JNeck load J�ort�2 <br /> iy Alasitpee, NIassachucsetts 02649 <br /> ��AiiiE Lam" <br /> Decision for a Variance <br /> RE: Patricia Voyles 55 Pequot Avenue <br /> Map 72 Parcel 68B <br /> V-08-41 <br /> A Petition was filed on August 22, 2008 for a Variance from Section 174-31 of <br /> the Zoning By-laws for relief from landspace requirements to deem this lot buildable. <br /> This property is located in an R-5 zoning district at 55 Pequot Avenue (Map 72 Parcel <br /> 68B) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 29, 2008 and <br /> September 5, 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2008, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, <br /> James Reiffarth, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Barry represents the applicant at this hearing. They have been granted a <br /> variance in the past on two different occasions. The variance expired due the fact that no <br /> building had begun on the lot. Mr. Barry informs the Board that they have filed with the <br /> Planning Board and a road design is being done at the present time. Mr. Nelson informs <br /> Mr. Barry that the road design is of no concern to them and they are just interested in the <br /> lot itself.
