Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 29, 2008 and <br /> September 5, 2008, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2008, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Jonathan Furbush, <br /> James Reiffarth, William Blaisdell and Jack Dorsey. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Barry represents the applicant at this hearing. They have been granted a <br /> variance in the past on two different occasions. The variance expired due the fact that no <br /> building had begun on the lot. Mr. Barry informs the Board that they have filed with the <br /> Planning Board and a road design is being done at the present time. Mr. Nelson informs <br /> Mr. Barry that the road design is of no concern to them and they are just interested in the <br /> lot itself.
