Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, October 3, 2008 and October
10, 2008 a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, October 22, 2008, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Peter Hinden, James
Reiffarth, Jonathan Furbush and William Blaisdell.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Richard Harris represents himself at this hearing. The Board reviews the plans
with applicant and Mr. Nelson explains that he will need a 6' foot opening or the addition
will be considered a bedroom. The Board of Health has indicated that he is allowed a 5
bedroom dwelling. Mr. Harris informs the board that his intention is for this to be a
living room. The Board will need new plans drawn up to show the proposed deck rather
than just what is existing on the plans. Mr. Harris agrees to have new plans dropped off
as soon as possible. James Reiffarth makes a motion to grant a 6.9 foot variance to
Ashument Avenue since the set back requirement is 40 feet. Jonathan Furbush seconds
the motion. All agree. So moved. The variance is granted contingent on plans from
