lown of Alashwe <br />16 Crt•cat -Neck load ,Nor th <br />IYIasil,pce AlassachLtsctts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for a Variance <br />RE: Richard Harris 71 Ashumet Ave. <br />Map 41 Parcel 24 <br />V-08-47 <br />A Petition was filed on April 14, 2008 for a Variance from Section 174-31 of the <br />Zoning By-laws in order to expand the living space to build a living room on property <br />located in an R-5 zoning district at 71 Ashumet Road (Map 41 Parcel 24) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, October 3, 2008 and October <br />10, 2008 a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, October 22, 2008, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Robert Nelson, Peter Hinden, James <br />Reiffarth, Jonathan Furbush and William Blaisdell. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Richard Harris represents himself at this hearing. They are seeking a variance on <br />the front setback in order to build a 12' x 24' living room. The Board reviews the plans <br />with applicant and Mr. Nelson explains that he will need a 6' foot opening or the addition <br />will be considered a bedroom. The Board of Health has indicated that he is allowed a 5 <br />bedroom dwelling. Mr. Harris informs the board that his intention is for this to be a <br />living room. The Board will need new plans drawn up to show the proposed deck rather <br />than just what is existing on the plans. Mr. Harris agrees to have new plans dropped off <br />as soon as possible. James Reiffarth makes a motion to grant a 6.9 foot variance to <br />Ashument Avenue since the set back requirement is 40 feet. Jonathan Furbush seconds <br />the motion. All agree. So moved. The variance is granted contingent on plans from <br />
