Mashpee Zoning <br />Board of Appeals Fraiflc Silva <br />Modification of Special Permit <br />2 SP-08-48 <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant <br />to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and <br />the Town of Mashpee Zoning By-laws <br />Diane Thompson, a zoning consultant represents Frank Silva, owner. <br />Mr. Silva was previously granted a Special Permit (SP-04-29) to construct <br />and operate a commercial building where he would lease/sell contractor <br />bays. Upon a new applicant coining to the Board to obtain a Special Permit <br />to operate an autobody repair shop, it was determined that there were a <br />number of things required in the original Special that were not completed. <br />Some of the changes were attributed to Mr. Beaulieu's request to run an auto <br />body shop, however there are several other issues that were the <br />responsibility of the owner of the property, Mr. Silva. He has filed a <br />Modification of the Original Special Permit (SP-08-48) in order to extend <br />the time for him to complete these items. Along with a Special Permit filed <br />by Mr. Beaulieu (SP-08-37) Mr. Silva has agreed to complete all <br />requirements set forth by the ZBA by December 31, 2009. Ms. Thompson <br />informs the Board that the items below have been addressed as follows: <br />1) Adequacy of parking: the site plan review determined that 26 <br />parking spaces are adequate for the existing uses and the proposed <br />use for automotive repair. Two handicapped spots (one van <br />accessible) are provided in accordance with ADA requirements. <br />2) Sprinkler System: a letter from James McHuth, JB Engineering <br />was submitted to the Fire Department and the ZBA which states <br />that the sprinkler system was installed in the building for the <br />contractor use is also adequate for the automotive repair shop. <br />3) Firewall Separation — Inspected by Building Commissioner, <br />Richard Stevens. <br />
