Mashpee Zoning <br />Board of Appeals Frank Silva <br />- Modification of Special Permit <br />5 SP-08-48 <br />SPECIFIC FINDINGS <br />1. the proposed use and development are consistent with applicable law, <br />rules and regulations. <br />2. there will be no adverse effect on public health or safety. <br />3. there will not be an excessive demand upon community facilities <br />created as a result of the proposal. <br />4. there will not be a significant adverse impact on the environmental <br />factors listed in Section 174-24.C.2.\ <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found <br />that the Petitioner met the criteria necessary for the granting of the <br />Modification of the Special Permit. Upon motion duly made and seconded, <br />the Zoning Board of Appeals voted unanimously on November 12, 2008 to <br />grant the Modification of the Special Permit subject to full compliance with <br />the plans from J.E. Landers-Cauley, PE., West Falmouth, MA, dated <br />September 4, 2008, Job No. 1349COND (called "Leaching Field Addition <br />Plan"); plans from J.E. Landers-Cauley, of West Falmouth, MA, dated <br />January 23, 2004, revised February 16, 2005, and revised April 5, 2004 <br />(called "Site Plan") showing parking and landscaping; letter from James <br />McHugh, Fire Protection Specialist dated September 30, 2008. The within <br />approval of the Special Permit Modification is subject to the condition that <br />that the seven enumerated items of work set forth at pages 2-3 herein shall be <br />completed no later than December 31, 2009; failure to satisfactorily complete <br />said items by that date shall result in rescission of the Special Permit for the <br />entire building without further action of the Board. <br />
