wn of Mashpee <br /> 16 Grew -MA &acl Not-t,h <br /> Nlashpcc, lVa,ssachuscus 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Eric and Dawn Peterson 112 Wading Place Road <br /> Map I I I Parcel 108 <br /> V-07-04 <br /> A Petition was filed on November 30, 2006 for a Variance from the setback <br /> requirements and landspace requirements from Section 174-31 of the Zoning By-laws in <br /> order to build a 34' x 34' garage on property located in an R-3 zoning district at 112 <br /> Wading Place Road (Map 111 Parcel 108) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise <br /> a newspaper of general circulation in the To«ln of Mashpee, on December 22, 2006 and <br /> December 29, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee 'town Ball on <br /> Wednesday, January 10, 2007, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Frederick Bergeson and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape &Islands Engineering represents the applicants at this <br /> hearing. They are seeking a special permit in order to alter a pre-existing non- <br /> conforming lot and a variance for relief from setback requirements and existing landspace <br /> requirements in order to build a garage. Initially the words "expand existing living <br /> space" should be striker from the application. There is an existing dwelling already in <br /> the coastal bank and they are seeking to build a 34' x 34' garage. They cannot meet the <br /> setback requirements from Wading Place Road. The Board discusses options to remove <br /> the odd angles of the garage. Marshall Breen moves to grant an 11.3 foot frontyard <br /> setback variative to Wading Place Road and a 14,000 square foot landspace variance. <br /> Jonathan Furbush seconds the motion. All agree. <br />
