�,totvnr� <br /> t . <br /> wn of Nashpee <br /> 16 Great Neck (toad_Noah <br /> «�!�.� h,Tasl2pee, 1Vassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Re: Eric and Dawn Peterson H 2 Wading Place Roacl <br /> Map 111 Parcel 108 <br /> SP-07-05 <br /> A Petition was filed on December 19, 2006 for a Special Permit tinder Section <br /> 174-17 of the Zoning By-laws in order to alter a pre-existing non-conforming lot by <br /> building a garage on property located in an R-3 zoning district at 112 Wading Place Road <br /> (Map I I I Parcel 108) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 22, 2006 and <br /> December 29, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 2007 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Frederick Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicants at this <br /> hearing. They are seeking a special permit in order to alter a pre-existing non- <br /> conforming lot and a variance for relief fronn setback requirements and existing landspace <br /> requirements in order to build a garage. Initially the words "expand existing living <br /> space" should be striken from the application. There is an existing dwelling already in <br /> the coastal bank and they are seeking to build a 34' x 34' garage. They cannot meet the <br /> setback requirements from Wading Place Road. Robert Nelson does not feel comfortable <br />
