Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on December 22, 2006 and <br /> December 29, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 2007 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Frederick Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicants at this <br /> hearing. They are seeking a special permit in order to alter a pre-existing non- <br /> conforming lot and a variance for relief fronn setback requirements and existing landspace <br /> requirements in order to build a garage. Initially the words "expand existing living <br /> space" should be striken from the application. There is an existing dwelling already in <br /> the coastal bank and they are seeking to build a 34' x 34' garage. They cannot meet the <br /> setback requirements from Wading Place Road.
