e <br /> improved by a single family dwelling located at 112 Wading Place Road, Mashpee, MA by <br /> virtue of a deed dated December 1, 1997 and filed for registration in the Barnstable County <br /> Registry District of the Land Court as Document No. 711,083 on Certificate of Title No. <br /> 146746, to which reference is made for a more complete description of said real property and <br /> are necessary parties to this action under Massachusetts General Laws Chapter 40A, Section 17. <br /> 3. The defendants, Chairman Robert G. Nelson, Marshall Brem, Zella Elizenberry, <br /> Frederick Borgeson and Jonathan Furbush are, or were at all relevant times, duly constituted <br /> members of the Zoning Board of Appeals of the Town of Mashpee (hereinafter "the defendant <br /> Board"),with addresses as follows: <br /> a. Robert G.Nelson,27 Tradewind Drive,Mashpee,MA 02649 <br /> b. Marshall Brem, 21 Harbor Ridge Drive,Mashpee,MA 02649 <br /> C. Zella Elizenberry, 18 Terry Avenue,Mashpee,MA 02649 <br /> d. Frederick Borgeson, 10 Preakness Lane,Mashpee,MA 02649 <br /> C. Jonathan Furbush, 57 Greensward Road,Mashpee,MA 02649 <br /> 4. 108 Wading Place Road, Mashpee, MA directly abuts 112 Wading Place Road, <br /> Mashpee,MA. <br /> 5. The plaintiffs are aggrieved within the meaning of General Laws, Chapter 40A, Section <br /> 17 as amended,by the decisions of the Zoning Board of Appeals of the Town of Mashpee to: 1) <br /> grant a variance to the Defendants, Eric and Dawn A. Peterson, from the provisions of Section <br /> 174-31 of the Mashpee Zoning By-laws as to front yard set back and landscaping requirements; <br /> and 2) grant a special permit to the said Defendants pursuant to Section 174-20 and Section <br /> 174-24 of the Mashpee Zoning By-laws both for the construction of a proposed 34' x 34' <br /> detached free standing garage on the above-described premises of the said Defendants. <br /> 2 <br />
