Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, December 22, 2006, and <br /> December 29, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 10, 2007 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and Frederick Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Kathleen Girelli represents herself at this hearing. She is seeking to legalize an <br /> existing accessoary apartment that is currently in her basement. The Board reviews the <br /> floor plans and pictures she has submitted and reminds the applicant that dwelling must <br /> be owner occupied and shall not be granted in perpetuity. She has completed the Plan <br /> Review Process as well. The Board of Health has allowed up to 4 bedrooms in the <br /> dwelling. There still needs to be an inspection by the Building hlspector. Marshall Brem <br /> makes a motion to grant the special permit. <br /> GENERAL FINDINGS <br /> 1. that the subject pot is located at 32 Highview Avenue and contains 11,850 <br /> square feet. <br />
