Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 12, 2007 and <br /> January 19, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 24, 2007 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush, and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinksy of Cape & Islands Engineering represent the applicants at this <br /> hearing. There are 2 vacant lots in this application to be discussed— although Mr. Nelson <br /> points out that 352 Monomoscoy Road has been staked. There exists a shared permitted <br /> dock. Applicant is now seeking this to be changed to two smaller docks that don't go out <br /> as far. This has been suggested by the Harbormaster and Shellfish. Conservation has <br /> also approved this. The board discusses the fact that there is suppose to be a house on the <br /> property before a dock permit is issued. It has been done before that the Board can <br /> condition that substantial commencement of construction be completed before the dock is <br /> C <br />
