Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, January 12, 2007 and January <br /> 19, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the 1\/Iashpee Town Hall on <br /> Wednesday, February 28, 2007 at which time the foliov-ving members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> James and Erika Stovich represent themselves at this hearing. They are seeking a <br /> Special Permit in order to build an accessory apartment. The Board reviews the plans <br /> and Zella Elizenberry informs them that the dwelling must be owner occupied and that <br /> the permit is not given in perpetuity. This shall also be conditioned on approval from the <br /> Board of Health. The Board moves to grant the Special Permit. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 19 Pierre Vernier Drive and contains 16,500 <br /> square feet. <br />
