Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on January 12, 2007 and <br /> January 19, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 24, 2007, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, James <br /> Reiffarth, Frederick Borgeson and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Rob Mills of Wynn & Wynn represents the applicant at this hearing. <br /> They are seeking a Special Permit and Variance in order to build an addition on a pre- <br /> existing non-conforming lot. This is a cluster subdivision and the setback requirements <br /> are 20 feet. They are seeking 10.2 feet in the rear and 2.7 feet on the sideyard. The <br /> Board feels the Special Permit is not necessary and to just move forward with the <br /> variance request. Attorney Mills requests to withdraw the Special Permit. The Board <br /> reviews the plans and checks the lot coverage which is 17.7% with the proposed addition. <br /> Frederick Borgeson moves to grant a 10.2 foot variance in the rear and a 2.7 foot variance <br /> on the sideyard. <br />
