TOWN OF MASHPEE <br />Zoning Board of Appeals <br />Minutes — Wednesday, January 10, 2007 <br />The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, January <br />10, 2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry, <br />Frederick Borgeson, Marshall Brem and Jonathan Furbush were present along with <br />alternate members James Reiffarth, and Eric Dublirer. Alternate members George Boton <br />and Martin Gordon were absent. , 1 <br />Mr. Nelson brought the meeting to order at 7:00 p.m. <br />Zella Elizenberry read the continuances for tonight's hearing. <br />Continued Hearings <br />David Hufnazel: Requests a Special Permit from Sections 174-17 and 174-20 in order <br />to demolish existing dwelling and rebuild a new dwelling on property located in an R-3 <br />zoning' district at 58 Monomoscoy Road West (Map 114 Parcel 95) Mashpee, MA. <br />• Owner of Record: .lames Kahveit <br />David Hufnaeel: Requests a Variance from Section 174-31 to seek relief from the <br />setback requirements and landspace requirements in order to rebuild a new dwelling on <br />property located in an R-3 zoning district at 58 Monomoscoy Road West (Map 114 <br />Parcel 95) Mashpee, MA. Owner of Record: James Kahveit <br />Sitting: Robert Nelson, Zella Elizenberry, Marshall Brem, Frederick Borgeson, and <br />Jonathan Furbush; <br />Alexander Watt, Esq.,along with Jack Landers-Cauley represent Mr. Hufnagel. This <br />matter was originally heard on September 13, 2006 continued to October 25, 2006, then <br />to December 13, 2006 and then January 10, 2007 whereby the applicant seeks to raze and <br />replace existing dwelling with a new three bedroom dwelling. There were many <br />continuances due to concerns from the DPW, Fire Department and plans needing to be <br />re -drawn depicting said requests. The Board had asked for applicant to satisfy all <br />requests from the Fire Department and the DPW with respect to signs on the roads and <br />widening the street for access by emergency vehicles. Mr. Nelson reads into the record <br />the emails from the DPW and Fire Department stating that once all requirements are <br />complete, they will be satisfied. The Board discusses notifying the abutters specifically <br />on widening the road just for a courtesy purpose since it will affect them directly. <br />Attorney Watt mentions they do not want any legal ramifications from this notification. <br />• It is decided a letter will be written by the applicant to just inform the abutters about the <br />street improvement. The Board also conditions this matter on an admistrative <br />
