Mashpee Zoning <br />Board of Appeals Minutes <br />2 February 28, 2007 <br />MarvTeresa & Charles Crealese: Request a Special Permit from Section 174-20 of the <br />Zoning By-laws in order to demolish and rebuild a new home on property located in an <br />R-3 zoning district at 49 Bluff Avenue (Map 117 Parcel 145) Mashpee, M.A. <br />MarvTeresa & Charles Crealese: Request a Variance from Section 174-31 of the <br />Zoning By-laws to seek relief from the iandspace requirements in order to demolish and <br />rebuild a new home on property located in an R-3 zoning district at 49 Bluff Avenue <br />(Map 117 Parcel 145) Mashpee, MA. <br />Sitting: Robert Nelson, Zella Elizenberry, Frederick Borgeson, George Bolton and James <br />Reiffarth. <br />John Slavinsky represents the applicant at this hearing. They are seeking a Special <br />Permit to demolish existing structure and a variance on the lot size. Although this is in <br />the Popponesset Overlay District, the is 93 square feet short of the 6,000 square feet <br />needed. The Board reviews the plans and discusses the height of the dwelling. Mr. <br />Slavinsky informs them it will be 29.10 feet from the average grade and that lot coverage <br />will be Zella Elizenberry makes a motion to grant a Special Permit. Frederick Borgeson <br />seconds the motion. All agree. So moved. A roll call vote is taken. Zella Elizenberry <br />votes yes. Frederick Borgeson votes yes. George Bolton votes yes. James Reiffarth <br />votes yes. Zella Elizenberry makes a motion to grant a 93 square foot landspace <br />variance. Robert Nelson seconds the motion. All agree. So moved. James Reiffarth votes yes Reference plans from Cape & Islands Engineering dated <br />February 1, 2007, File No. 125MA. <br />Ruth ,Johnson: Requests a Special Permit from Section 174-25 E(l)(4) of the Zoning <br />By-laws in order to have a skin care/massage studio on property located in an 1(1) zoning <br />district at 759 Falmouth Road (Unit 4) (Map 81 Parcel 29) Mashpee, MA. Owner of <br />Record: Clover Development and Landscaping <br />Sitting: Robert Nelson, Zella Elizenberry, Frederick Borgeson, George Bolton and James <br />Reiffarth. <br />Ruth Johnson represents herself along with her husband at thus hearing. She is seeking a <br />special permit in order to have a skin care/massage studio in the Clover Building that <br />exists on Falmouth Road. The board reviews the plans and sees that the board of health <br />has signed off on the project. Frederick Borgeson makes a motion to grant the Special <br />Permit.
