Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on March 2, 2007 and March
March 9, 2007, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, March 14, 2007, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Marshall Brem, Frederick Borgeson and Jonathan Forbush.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
David Frye represents the applicant at this hearing. They are seeking a variance
in order to add/build an overhang on the building at the old Harwich Concrete Building
that Stonewood Products has taken over. It is a corner lot and they have no plans to
enclose the area tinder the overhang. The Board wishes to stipulate that it not be
enclosed. The requirement is 75 foot setback and the applicant is looking to have the
overhang sit at 69 feet which would require a 6 foot variance. Frederick Borgeson makes
a motion to grant.a 6 foot variance to the front of Main Street and Echo Road. Marshall
Brem seconds the motion. All agree. So moved. A roll call vote is taken. Frederick
" Borgeson votes yes. Marshall Brem votes yes. Zella Elizenberry votes yes. Jonathan
