Town of Mashpee <br /> 1G Great�1J�eck (�vad,Nort{� <br /> IJ2 slipee,Massach«setts 026 �J <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for Three-Year Extension <br /> Chapter 40B Comprehensive Permit <br /> SP-07-28 <br /> The 340-342 Main Street LLC <br /> O Dory Lane Book: 20779 Page: 20 <br /> Mashpee, Massachusetts 02649 Assessor's Map 36 Parcel 50 <br /> The Zoning Board of Appeals filed the above-referenced Decision SP-07-28 for a <br /> Chapter 40B Comprehensive Permit with the Town Clerk on August 9, 2007. <br /> The ZBA office received a letter dated July 16, 2010 from the Petitioner <br /> requesting a three-year Extension of the Comprehensive Permit. <br /> A Public Hearing was held on July 28, 2010 on the Request for Extension of the <br /> Comprehensive Permit SP-07-28. Upon motion duly made and seconded, the Mashpee <br /> Zoning Board of Appeals voted to grant a 60-day Extension to allow the Petitioner an <br /> opportunity to address the Board's questions. <br /> At the Public Hearings on August 25, 2010, the following members of the Board <br /> were present and acting throughout: Board Members Jonathan Furbush, William A. <br /> Blaisdell and James Reiffarth and Associate Board Members Peter R. Hinden and Ronald <br /> S. Bonvie. <br /> Attorney Kevin M. Kirrane and developer Mr. John McShane represented the <br /> Request for an Extension. Attorney Kirrane said that a limited dividend equity was <br /> created in order to develop this project with Southside Realty Trust as the applicant and <br /> The 340-342 Main Street, LLC as the owner of the permit. Attorney Kirrane said that, <br /> due to the economy, the Petitioner was unable to obtain financing for the project. In <br /> addition, a substantial mortgage exists on the subject property. The Petitioner is seeking <br /> a three-year extension with the anticipation that the economy will improve and sufficient <br /> financing can be secured for the project. <br /> Mr. Furbush referred to the list of issues that the Board requested the Petitioner to <br /> resolve. Mr. McShane said that a final top coat has been completed. He also said that the <br /> road has been cut in along with installation of some of the utilities. <br /> At the Public Hearings on August 25, 2010, the Board voted unanimously to grant <br /> a three-year Extension on the above-referenced Chapter 40B Comprehensive Permit. <br /> This Extension shall lapse on August 9, 2013. <br />
