�...: . 1 <br /> aslipee <br /> 16 Great deck Ikoad Nor-di <br /> A7ash,pcc, .Massach.Ltsetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Steven Lichtman 6 Pondview Avenue <br /> Map 58 Parcel 72 <br /> V-07'3D <br /> A Petition was filed on March 27, 2007 for a Variance from Section 174-31 of <br /> the Zoning By-laws to seek relief from the setback requirements in order to enclose a <br /> sunporch on property is located in an R-5 zoning district at 6 Pondview Ave. (Map 58 <br /> Parcel 72) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 30, 2007 and April <br /> 6, 2007 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 11, 2007 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Steven Lichtman represents himself at this hearing. He is seeking a variance in <br /> order to enclose an existing patio and make it a sunporch. He directly abuts Southport <br /> and needs 25 feet for a setback. The Board reviews his plans. An abutter, Cesar Aleman, <br /> informs the board that he is in full support of the project and feels it will enhance the <br /> neighborhood. The Board moves to grant a 14 foot variance in the rear and a 6.37 foot <br /> variance on the sideyard. All agree. So moved. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 6 Pondview Avenue and contains 10,920 <br /> square feet. <br />
