Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 15, 2007 and June 22., <br /> 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 27, 2007, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael McGrath of Holmes and McGrath represents the applicant at this hearing. <br /> They are seeking a special permit in order to build a pier, ramp aiid float and a variance <br /> to exceed the 70 foot maximum allowable limit for the length. Mr. McGrath inf6rms the <br /> Board that all criteria have been met for obtaining a special permit. The Shellfish Warden <br /> has approved the matter. There will be installation of a rip rap wall. The variance <br /> requested is 69 feet. The Board reviews the plans and find the request to be acceptable <br /> for the installation of a pier, ramp and float. Marshall Bern moves to grant a 69 foot <br /> variance. <br />
