This property is located in an R-3 zoning district at 403 Great <br /> Oak Road (Map 126 Parcel 48) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 15, 2007 and June 22, <br /> 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 27, 2007, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Marshall <br /> Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the applicant at this <br /> hearing. They are seeking to file another variance whereby the existing variance has <br /> exipired. Mr. MacLellan was unaware that his variance was only good for one year. The <br /> variance is to make the lot buildable since it is in the flood zone, too close to the ACEC <br /> and the lot is too small. The new dwelling proposed is smaller than the original one and <br /> is farther away from the ACEC. They are seeking a 23 foot variance to the ACEC and a <br /> 20,824 square foot landspace variance to deem lot buildable. The Board reviews the <br /> plans and find it to be less detrimental than the previously proposed dwelling. .lonathan <br /> Furbush moves to grant the requested variances. <br />
