Applicant has been <br />through the Plan Review/Design Review process and incorporated all requested changes. <br />'['here is adequate parking whereby applicant has made the spaces 9.5 feet as Tom Fudala <br />had suggested. The fire department has approved the building and the building itself is' <br />adequate for the proposed uses and there is one hour fire separation between the walls. <br />There will be 100 feet of separation between the buildings and the proposed uses have <br />been put on the plans themselves. Mr. Bevalaqua indicates to the Board that he intends to <br />build both buildings right away and there will be a maximum of 4 units per building. "rile <br />square footage will be 9.984 square feet as ou wit i ape s . The <br />Board discusses the 6' of reclaimed asphalt and Mr. Slavinsky informs them that this is <br />better than gravel. The handicapped parking will be flexible. The Board requests a <br />$ 10,000 landscaping bond and this will be done through the Building Department. <br />Jonathan Forbush makes a motion to grant a special permit. James Reiffarth seconds the <br />motion. All agree. So moved. A roll call vote is taken. Jonathan Furbush votes yes. <br />James Reiffarth votes yes. Zella Elizenberry votes yes. Robert Nelson votes yes. <br />Marshall Brem votes yes. Special Permit is conditioned on plans from Cape & Islands <br />Engineering, dated March 28, 2007, revised April 10. 2007. revised May 15, 2007 and <br />revised June 11, 2007 and building plans from Priggen Steel Building. Co. of Wrentham. <br />MA, dated May 18, 2007. <br />• Seamist Builders: Request a Variance from Sections 174-33, 174-85 and 174-31 of the <br />zoning by-laws to seek relief from the required distance to wetlands, the required distance <br />to ACEC and landspace requirements in order to deem lot buildable. Previous variance <br />has expired. Said request is on property located in an R-3 zoning district at 403 Great <br />Oak Road (Map 126 Parcel 48) Mashpee. NIA. <br />Sitting: Robert Nelson. Zella'Elizenbery. Marshall Brem. Jonathan Furbush and .lames <br />Reiffarth. <br />John Slavinsky of Cape & Islands Engineering represents the applicant at this hearing. <br />They are seeking to file another variance whereby the existing variance has exipired. Mr. <br />MacLellan was unaware that his variance was only good for one year. The variance is to <br />make the lot buildable since it is in the flood zone, too close to the ACEC and the lot is <br />too small. The new dwelling proposed is smaller than the original one and is farther <br />away from the ACEC. They are seeking a 23 foot variance to the'ACEC and a 20.824 <br />square foot landspace variance to deem lot buildable. "file Board reviews the plaits and <br />figd it to be less detrimental than the previously proposed dwelling. Jonathan Furbush <br />moves to grant the requested variances.
