Notice was given by publication in The Maslipee Enterprise, <br /> a newspaper of general circulation in the I'mvii of Mashpee, on June 22, 2007 and Rilic <br /> 29, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 11, 2007 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Jonathan <br /> Furbush, James Reiffarth and George Bolton. <br /> The Mashpee Zoning 13oai-cl of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and theToNvji of <br /> Mashpee Zoning By-laws. <br /> Paul Fleming represents the applicant who is seeking a variance in order to build a <br /> deck. This property is in the overlay district which requires a 25 foot frontyard setback <br /> and 15 feet on the sides and rear. The Board reviews the plans. The lot coverage will be <br /> at 19.1%. The lot is also 4 square feet short of the required 6,000 and the board \vill grant <br /> that variance as well. Mr. Nelson sees no problem with the request although IIC will <br /> condition it that the structure remain a deck with no roof to be added at anytime. N/Ir. <br /> Fleming agrees with this condition. Jonathan Furbush moves to grant the following <br /> variances: <br /> A 4 square foot landspace variance <br /> A 6.8 foot front yard setback variance <br /> A 3.8 foot northerly sideline variance <br />
