Mashpee Zoning
Board of Appeals Minutes
4 July 25, 2007
units on property located in a C-2 and R-5 zoning district at 340/342 Mails Street (Map 36
Parcels 49 and 50) Mashpee, MA.
Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and George
Bolton.
Attorney Kevin Kirrane of Dunning &Kirrane represents the applicant at this continued
hearing on the second Chapter 40B on Center Street (Jonas property) . The Board is not
prepared to move forward with this project until all items in the first project have been
completed. Attorney Kirrane informs the Board they are prepared to lay the grass. They
discuss the difficulty in planting things during this time of year with the heat. He
suggests that the planting be done in September. This is reasonable. Mr. Nelson wants
the wood chips removed and put Hunch in. What was done at this property does not
match what was agreed on . It was not completed as they agreed on. The engineers, Mr.
Rowley and the Board discuss all aspects of the projects including the grading of the hill
and at what angle grass would grow and mulch would stay on the lull. The agree the
paving needs to be completed. They address Mr. Rowley's letter of July 18, 2007. In
summary, it is Mr. Talerman will include in the permit for the second project that nothing
will be allowed until the first project is complete; namely# 1-9 (excluding#8). The road
shall be built behind the last unit before any occupancy permits will be issued. The
Board feels a potential home buyer should not have to move in with road construction
going on behind them. No building permits will be issued for Phase II until these other
items are complete.
The time is nearing the end for the decision to be issued. Attorney Kirrane signs a letter
agreeing to an extension to file the Decision until August 17, 2007.
Zella Elizenberry makes a motion to adjourn the hearing. Jonathan Furbush seconds the
motion. All agree. So moved.
Hearing is adjourned at 10;40 p.m.
spectfUlly submitted,
Lori Corsi, Office Mgr.
ZBA
`5
