Mashpee Zoning
Board of Appeals Minutes
I July 25, 2007
• TOWN OF MASHPEE
Zoning Board of Appeals
Minutes — Wednesday, July 25, 2007
Regular Hearing AND McShane II Project 40B
The Mashpee Zoning Board of Appeals held a Public Hearing on Wednesday, July 25,
2007. at the Mashpee Town Hall. Board Members Robert Nelson, Zella Elizenberry,
Jonathan Furbush, James Reiffarth and George Bolton were present along with alternate
members Martin Gordon and William Blaisdell.
Robert Nelson opens the hearing at 7:00 p.m.
Zella Elizenberry reads the continuances.
Tuvetchi Fisher-Rodden: Requests a Special Permit from Section 174-25(D)(1) of the
Zoning By-laws in order to maintain an skin care/massage center on property located in
an I-1 -zoning district at 766 Falmouth Road (Map 88 Parcel 38) Mashpee, MA. Owner
leof Record: Moder Electronics. Inc.
Sitting: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and George
Bolton.
Tuyetchi Fisher-Rodden (Chi) represents herself at this hearing. She has worked with the
Building Inspector and the ZBA Office Manager to come to the position that she was told
she needed to apply for a Special Permit from the ZBA for a use permit in order to have
her skin care/massage business at this location at Building A, Unit A-7, 766 Falmouth
Road. The Building Inspector, Rich Stevens felt the by law 174-25 D(l)(2) were the by-
laws she needed relief from and referenced "or other" when reading the section 2 under
medical or similar use. It is noted that Section (2) was not printed in the Public Hearing
Notice and the Board made a motion to verbally amend the application to include Section
(2) of the by-law. All agree. So moved. Chi presents her case informing the Board of
what she plans to do in the unit she purchased at Madaket Place. She plans to do facials,
body massages for wellness, NO nails, no hair or hair salon related things and all things
related to skin care. This will be "by appointment' basis only. Mr. Nelson discusses the
parking problems in the complex. She is allowed 2 parking spots for her unit.
Employees are to park in the rear. Mr. Fubush has a problem with the parking as well
and feels it will be very crowded. Chi informs them that she only has 2 rooms which
would entail 2 clients plus 2 professionals working with them — totaling 4 people with the
employees parking in the rear. The Board asks her if she will have any retail there. She
• says that she will be selling products that are used on the clients if they are interested in
