Mashpee Zoning <br />Board of Appeals Minutes <br />4 July 25, 2007 <br />• units on property located in a C-2 and R-5 zoning district at 340/342 Main Street (Map 36 <br />Parcels 49 and 50) Mashpee, MA. <br />Sitting: Robert.Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and George <br />Bolton. <br />Attorney Kevin Kirrane of Dunning & Kirrane represents the applicant at this continued <br />hearing on the second Chapter 40B on Center Street (Jonas property) . The Board is not <br />prepared to move forward with this project until all items in the first project have been <br />completed. Attorney Kirrane informs the Board they are prepared to lay the grass. "fhey <br />discuss the difficulty in planting things during this time of year with the heat. He <br />suggests that the planting be done in September. This is reasonable. Mr. Nelson wants <br />the wood chips removed and put mulch in. What was done at this property does not <br />match what was agreed on . It was not completed as they agreed on. The engineers, Mr. <br />Rowley and the Board discuss all aspects of the projects including the grading of the hill <br />and at what angle grass would grow and mulch would stay on the hill. The agree the <br />paving needs to be completed. They address Mr. Rowley's letter of July 18, 2007. In <br />summary, it is Mr. Talerman will include in the permit for the second project that nothing <br />will be allowed until the first project is complete; namely # 1-9 (excluding #8). The road <br />shall be built behind the last unit before any occupancy permits will be issued. The <br />Board feels a potential home buyer should not have to move in with road construction <br />going on behind them. No building permits will be issued for Phase 11 until these other <br />• items are complete. <br />The time is nearing the end for the decision to be issued. Attorney Kirrane signs a letter <br />agreeing to an extension to file the Decision until August 17, 2007. <br />Zella Elizenberry makes a motion to adjourn the hearing. Jonathan Furbush seconds the <br />motion. All agree. So moved. <br />Hearing is adjourned at 10;40 p.m. <br />spectfully su mitted, <br />Lori Corsi, Office Mgr. <br />ZBA <br />
