Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on July 27, 2007 and August <br /> 3, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 8, 2007, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Jonathan Furbush, James Reiffarth and George Bolton. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Chairman Robert Nelson explains to the Board and the public that this is a hearing <br /> for"Findings of Fact" only. The ZBA has been asked to find that should they allows <br /> these buildings in questions to be torn down and rebuilt that it would not be more <br /> detrimental to the neighborhood. That is all they are required to find by this amended by- <br /> law. The Planning Board will be the permitting authority and will issues a Special Permit <br /> with all of the uses and specifics addressed. The ZBA has not done this since it was <br />
