y BOARD OF APPEALS <br /> � e <br /> 16 Cheat,,Aeck load JNot tl2 <br /> Decision for a Variance <br /> Mashpee, Massachusetts 02649 <br /> RE: Gail Lopes 27 Melissa Avenue <br /> Map 21 Parcel 13A&B <br /> V-07-54 <br /> A Petition was filed on August 1, 2007 for a Variance from Section 174-32 of the <br /> Zoning By-laws to seek relief from the requirement that a common driveway be paved on <br /> property located in an R-5 zoning district at 27 Melissa Avenue (Map 21 Block 13 A&B) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on August 10, 2007 and <br /> August 17, 2007, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 22, 2007 at which time the following members of the Zoning Board <br /> -it and acting throughout: Zella Elizenberry, Robert Nelson, <br /> of Appeals were prese <br /> Jonathan Furbush, George Bolton and James Reiffarth.. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Gail Lopes represents herself at this hearing. She has been before the Board <br /> recently and obtained a variance for the lot size which was granted. Now she was told <br /> she needed to come back to the ZBA for the paving of the common driveway. Fire Chief <br /> George Baker has submmited a letter in support stating that the widening of the approach <br /> of the driveway is acceptable and has the shape of"T" and adequate room for turning and <br /> fire apparatus. The Board agrees with the Fire Chief. Jonathan Furbush makes a motion <br /> to grant the Variance that relieves them of the burden of paving the driveway. Robert <br /> Nelson seconds the motion.
